More convictions

From time to time TvA will engage a specialist tax consultant. A recent newsletter article from one of our consultants in taxation 'Tax & More Ltd' highlighted the growing confidence of the IRD to take business owners to court and WIN.

Under the banner "More convictions" the article makes the valid observation that "the tax compliance environment has changed dramatically in recent years" and how "fraud is not the easiest crime to prove but Inland Revenue is getting better at it and is more willing to try".

Listed wins by Inland Revenue include;

  1. a high-profile tax adviser sentenced to a term of home detention and his co-offender sentenced to jail;
  2. Wellington supermarket owner was sentenced to home detention for filing false GST returns;
  3. Auckland company director sentenced to jail for claiming tax refunds to which they were not entitled;
  4. Napier businessman was found guilty of aiding and abetting his companies to knowingly fail to pay PAYE.
